2.1 Age Restriction (COPPA Compliance):

You must have the legal capacity to enter into a binding contract. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2.3 Geographic Restrictions:

The App is available globally. However, certain features may be restricted based on your location due to legal or technical limitations.

3.1 License Grant:

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Access and use the App for personal productivity purposes
• Access content and features available through the App

3.2 Restrictions - You May NOT:

• Reverse Engineer: Decompile, disassemble, reverse engineer, or attempt to derive source code from the App
• Modify: Modify, adapt, translate, or create derivative works based on the App
• Redistribute: Rent, lease, sell, sublicense, distribute, or transfer the App to third parties
• Remove Notices: Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Circumvent Security: Bypass, disable, or interfere with security features or access restrictions
• Automate: Use bots, scrapers, or automated tools to access the App
• Malicious Activity: Upload viruses, malware, or any harmful code
• Illegal Use: Use the App for any unlawful purpose or in violation of applicable laws

3.3 Ownership:

Task Bunny and all intellectual property rights (including copyrights, trademarks, patents, trade secrets, and design rights) remain the exclusive property of Olena Group. These Terms do not grant you any ownership rights to the App.

4.1 Account Creation:

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities under your account

You may delete your account at any time using our Account Deletion process. We may suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

6.1 Your Content:

You retain all ownership rights to the content you create, upload, or store in Task Bunny, including tasks, notes, projects, habits, and other data ("User Content").

6.2 License to Use Your Content:

By using the App, you grant us a limited license to:

• Store and process your User Content to provide services
• Backup and sync your User Content across your devices
• Use anonymized, aggregated data derived from User Content to improve the App

Important: We will never share, sell, or publicly display your personal User Content without your explicit consent.

6.3 Content Responsibility:

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to your content
• Your content does not violate any laws or third-party rights
• Your content does not contain viruses, malware, or harmful code
• Your content is not obscene, defamatory, or otherwise objectionable

6.4 Content Removal:

We reserve the right (but have no obligation) to review, remove, or disable access to User Content that violates these Terms or applicable laws. We are not responsible for monitoring or controlling User Content.

7.1 AI Assistant:

Task Bunny includes Bunny AI, an artificial intelligence assistant that provides smart suggestions, task recommendations, and productivity insights based on your usage patterns.

7.2 AI Data Usage:

• Bunny AI analyzes your tasks and habits to provide personalized recommendations
• AI queries are processed using third-party AI services (e.g., OpenAI)
• We anonymize and encrypt data sent to AI providers for processing
• AI-generated suggestions are provided "as is" without guarantees of accuracy

7.3 AI Limitations:

9.1 No Warranties:

To the fullest extent permitted by law, we disclaim all warranties, including:

• Merchantability: The App is fit for a particular purpose
• Non-Infringement: The App does not violate third-party rights
• Accuracy: Information provided is accurate or complete
• Uninterrupted Service: The App will be error-free or continuously available
• Data Loss: Your data will not be lost or corrupted

9.2 Service Availability:

We do not guarantee that Task Bunny will be available at all times. The App may experience downtime due to maintenance, updates, technical issues, or circumstances beyond our control.

9.3 Third-Party Services:

Task Bunny may integrate with third-party services (Google Calendar, Apple Reminders, cloud storage). We are not responsible for the availability, functionality, or security of third-party services.

10.1 Damages Cap:

Our total liability to you for all claims arising from or related to the App shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) £100 GBP.

10.2 Excluded Damages:

We shall not be liable for:

• Loss of profits, revenue, or business opportunities
• Loss of data or content
• Loss of goodwill or reputation
• Costs of substitute products or services
• Damages resulting from unauthorized access to your account
• Third-party actions or services

10.3 Essential Purpose:

If any limitation in these Terms is found to be invalid, the remaining limitations shall remain in effect. The limitations in this section apply even if any remedy fails of its essential purpose.

12.1 Termination by You:

You may stop using Task Bunny and delete your account at any time through our Account Deletion page. Upon deletion, your data will be permanently removed within 30 days (subject to legal retention requirements).

12.2 Termination by Us:

We may suspend or terminate your access to Task Bunny immediately, without notice, if:

• You violate these Terms or our policies
• You engage in fraudulent, abusive, or illegal activities
• You fail to pay subscription fees
• We are required to do so by law
• We discontinue the App (with 30 days' notice)

12.3 Effect of Termination:

Upon termination:

• Your license to use the App immediately ends
• You lose access to your account and data
• No refunds will be provided for unused subscription time
• Sections of these Terms that by their nature should survive (warranties, limitations, indemnification) remain in effect

13.1 Governing Law:

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

13.2 Jurisdiction:

You agree that any disputes arising from these Terms or your use of Task Bunny shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13.3 Informal Resolution:

Before filing a legal claim, you agree to first contact us at shakir@olenagroup.dev to attempt to resolve the dispute informally. We will work in good faith to resolve disputes amicably.

13.4 Class Action Waiver:

To the extent permitted by law, you agree to bring claims against us only in your individual capacity and not as part of any class or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14.1 Changes to Terms:

We may update these Terms from time to time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Your continued use of Task Bunny after changes become effective constitutes acceptance of the updated Terms.

14.2 Entire Agreement:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Olena Group regarding Task Bunny and supersede all prior agreements.

14.3 Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.4 Waiver:

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.5 Assignment:

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction (e.g., in case of merger or acquisition).

14.6 Force Majeure:

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, pandemic, or government actions.

14.7 Export Compliance:

You agree to comply with all applicable export and import laws and regulations. You may not use Task Bunny in countries subject to embargo or sanctions.
